This privacy policy (“Privacy Policy”) describes the privacy practices of Mispar (“Company,” “we” or “us”). 

Company receives, collects, stores and manages personal information according to the following Privacy Policy. “Personal Information” is information that relates to an identified or identifiable individual. Company is committed to comply with data privacy laws, where applicable.  This Privacy Policy is made in accordance with applicable privacy regulations and GDPR (to the extent applicable).

By using our website Mispar.co (hereinafter referred to as the “Website”), and/or receiving services and/or by accepting this Privacy Policy in any form or method, you agree to the terms and conditions of this Privacy Policy. This Privacy Policy is a policy of our company and applies to all our users, partners and customers whether they access our Website or not. The customers and/or partners can electronically or by signing a special consent form, accept these terms, as directed by us.

This Privacy Policy forms a binding agreement between Company and the user of the Website (hereinafter referred to as the “Customer”) and between Company and its panelists connected through the Panelfox (hereinafter referred to as the “Panelist”). Customers and Panelists are together referred as “you”.

1. Personal Information Collected From Customers and Panelists

1.1 Customer may provide us with its Personal Information in a number of ways, including, without limitation, when it:

- Requests support;

1.2 Customer hereby acknowledges that collecting Personal Information from Customer is essential in order to provide it with our services.

1.3 The Personal Information we receive from Customer includes its name, business name, business address, zip-code, email and credit card information.

1.4 Company may receive this data from Customer when it manually enters or otherwise discloses such data. 

1.5 By providing us with its Personal Information, Customer consents to this data being collected, used, disclosed, transferred to the relevant third parties for the purposes of providing it with our services, and stored by us, as described in this Privacy Policy.

1.6 For the avoidance of doubt, Customer hereby acknowledges that we do not store its Personal Information, unless it is necessary for legal purposes, providing services or we have a consent from it.

1.7 We connect with our Panelists through Panelfox for the purposes of gathering information through studies. Panelists voluntarily participate in our studies and for this, provide us with their Personal Information such as their age, marital status, zip code, such as their age, marital status, zip code, email address, gender, parental status, employment status, income bracket, affiliation & living arrangement.

1.8 We collect Personal Information from Panelists based on their consent when they manually enter or otherwise disclose such data.

1.9 By providing us with its Personal Information, Panelist consents to this data being collected, used, disclosed, sold, transferred to the relevant third parties and stored by us, as described in this Privacy Policy.

2. How We Use Personal Information We Collect

2.1.2 To process payments where applicable;

2.1.3 To personalize Customer experience when using our Website;

2.1.4 To communicate with Customers about our Website, services and provide Customer care in response to their inquiries;

2.1.5 To reach you in case we conduct sweepstakes and/or raffles;

2.1.6 To enforce compliance with the applicable law, governmental or judicial orders;

2.1.7 To protect our rights and safety as well as rights and safety of our users and third parties;

2.1.8 To provide information to representatives and advisors;

2.1.9 To prosecute and defend a court, arbitration, or similar legal proceeding;

2.2  We do not sell Panelists’ Personal Information. However, we may use and share aggregated and anonymized data, derived from the information Panelist provides, for selling purposes. This general data does not include any personally identifiable information and may be shared with third parties, such as Customers, advertisers, partners, and other entities, for their marketing, advertising, promotional and other purposes. By participating in the survey, Panelist consents to the use and sharing of this anonymized and aggregated data. If Panelist has any concerns or wishes to opt-out, it shall contact us through the methods specified in this Privacy Policy.

3. Who Do We Disclose Personal Information To 

3.1 We do not share Customer’s or Panelist’s Personal Information, unless:

3.1.1 Doing so is appropriate to carry out Customer’s own request, including sharing or giving access to its Personal Information to our service providers for the purposes of providing services;

3.1.2 We believe it is needed to enforce our Privacy Policy, or if it is required, requested or demanded by law or any regulation or order;

3.1.3 We believe it is needed to detect, prevent or address fraud, security or technical issues;

3.1.4 We otherwise protect our property, legal rights, or that of others.

3.2 We do not share Customer’s Personal Information with third parties, except for our vendors and service providers, such as hosting services, cloud services, and other information technology services providers, email communication software and email newsletter services, advertising and marketing services, customer relationship management and customer support services, and web analytics services without Customer’s prior written consent (including via email). 

3.3 Customer hereby acknowledges that we use Hubspot for contact relationship management and Jotform for their convenience when filling forms.

3.4 Panelist hereby acknowledges that we use Panelfox for panel management and research recruitment.

4. Safeguarding and Retention of Your Personal Information

4.1 The protection of your Personal Information is vital to us. We take commercially reasonable measures to protect your Personal Information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction, taking into account the risks involved in the processing and the nature of the Personal Information. These security measures include, but are not limited to actions and programs like web application firewall, intrusion detection, blocking of hostile countries by IP address.

4.2 Our employees, contractors, and any business partners can access your Personal Information on a need to know basis, and we direct them to comply with the confidentiality and use terms of this Privacy Policy. While we strive to use commercially reasonable means to protect your Personal Information, no method of transmission over the Internet, or method of electronic storage, is completely secure, and we cannot guarantee absolute security of any data.

4.3 We retain your Personal Information for as long as necessary to fulfill the purposes for which it was collected, including any legal, accounting, or reporting requirements. The retention period for your Personal Information will be determined based on the nature of the information, the purposes for its collection, and the applicable legal and regulatory obligations.

Please be aware that we are not responsible for the privacy practices of such third parties. 5.2 Additionally, third parties that we partner with for advertising, analytics, and other services may collect information about your online activities over time and across different websites. These third parties are responsible for their own compliance with applicable privacy laws and regulations. We do not have control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party sites or services.

6. GDPR

6.1 Under the General Data Protection Regulation, individuals located in the EU have extra rights and their personal information is called Personal Data.  

6.2 Special Rights for EU Individuals:

6.2.1 Objecting to processing: You have the right to object to processing of your Personal Data that is based on our legitimate interests or public interest. We do not specifically market to children under 13. If we learn that a child's personal data was collected without appropriate authorization, it will be deleted as soon as reasonably possible.
